ASIATODAY.ID, JAKARTA – Chairman of the Indonesian Inter-Parliamentary Cooperation Agency (BKSAP) Mardani Ali Sera strongly criticized United States President Donald Trump’s plan to relocate Palestinians outside the Gaza Strip and take over the Gaza Strip.

“Trump’s statement is very provocative. Therefore we must oppose it,” said Mardani in his statement in Jakarta, Friday, February 7 2025.

According to him, Trump’s idea of defying international law, parameters and norms will erase the Palestinian people’s right to determine their own fate, as well as support Israel’s plan to carry out ethnic cleansing.

Mardani urged the US and all parties to comply with the foundations of international law, including the 1949 Geneva Convention which prohibits the forced transfer of people from occupied territories.

“Both the United States and Israel have ratified this convention, so what they are doing violates international rules that they themselves have agreed to,” he said.

He then cited the Rome Statute of the International Criminal Court, which in Article 7 and Article 8 states that the direct or indirect transfer by the occupying power of part of its own civilian population to the territory it occupies, or the deportation or transfer of all or part of the population of the occupied territory into or out of this territory.

“This can be interpreted as a war crime. Trump’s statement indicates that the United States feels it has long-term occupying power over Palestinian land,” he said.

Mardani also reminded the US and Israel that genocide is a crime against humanity regulated in the Convention on the Prevention and Punishment of the Crime of Genocide. The convention was passed by the UN General Assembly in 1948 and was signed by the US and Israel.

“Perpetrators of genocide can be subject to sanctions in the form of prison sentences, fines and confiscation by the International Criminal Court (ICC), which has the legal authority to prosecute perpetrators of genocide,” he said.

Mardani also urged the Indonesian government to take a firm stance in rejecting Trump’s plan, as well as mobilizing international support for the Palestinian people.

“We must pressure Israel to comply with various international laws through bilateral and multilateral diplomacy, as well as other international mechanisms. We must not create the impression that the current ceasefire is washing away sins for Israel’s crimes,” he explained.

He considers it necessary for Indonesia to continue to support countries at the UN to comply with and implement the decisions of the ICC and ICJ by continuing to prosecute Israel and its leaders for the crimes of genocide, apartheid and other crimes against humanity.

He also called on the international community, including the United Nations, the Organization of Islamic Cooperation and the Arab League to reject the plan and take diplomatic steps to prevent the forced displacement of Palestinians.

“The right to live in the Motherland is a fundamental right that cannot be contested. We stand with the Palestinian people in their struggle for justice and human rights,” he stressed.

Finally, Mardani emphasized BKSAP’s commitment to international conference forums that Indonesia will always support the Palestinian struggle to defend its rights.

“Primarily, Palestinian independence is based on the principle of a two-state solution with the 1967 territorial boundaries, including East Jerusalem as the capital of Palestine,” he said. (AT Network)
